Verizon Wireless Takes Alltel to Court Over Ads

Verizon Wireless has filed a false advertising lawsuit against Alltel. In the lawsuit, Verizon claims that Alltel falsely represented its position as the only carrier to allow customers to alter their service plans without lengthening the terms of their contract. Verizon changed its policy in October, permitting customers to change their plans without penalty. It then notified Alltel that the ad was misleading. Alltel said it changed the ad, but Verizon contends that Alltel continued to run the ad for over a month after Verizon contacted Alltel. Damages were not specified.

A judge has refused to grant a temporary restraining order that would have forced Alltel Wireless to drop an advertisement.

While the ad may technically constitute false advertising, you have to consider that it was conceived before VZW (and later AT&T) changed their policies. I don't know what the legal situation is on this, but I would think that VZW unpredictably changing one of its policies shouldn't have an adverse affect on another company, in this case ALLTEL, since the original existing ad represents a somewhat significant investment on their part and they designed it to run for a certain amou...
