In non-bs talk, it's like this:
1. Sprint wants a bit back from all the data that the owners of these phones would inevitably be using, and as such "taking advantage" of the unlimited data and making Sprint lose in the transaction;
2. Sprint rents the spectrum from Clear, and so it is a way to pass the costs down to the customer;
3. Sprint will tell you that, even with the premium data charge, you'd still pay more with another carrier for the same service and support, and T-Mobile is the only one who still currently offers unlimited data for smartphones...

...Everything Data has unlimited data for smartphones; it's only the 'brand new 4G network capable' phones getting charged that $10.
If we charged $10 for every smart phone, we'd have been outta business a while ago; we don't offer tiered yet; thus we're still "unlimited" in that sense.
But agreed; don't bother with the class action suit; it's not worth it.

Additionally, Menno was able to go through the store as if he were a new customer, and it only had the $15 150MB, $30 Unlimited, or $45 Business plans.
