I had another tentative customer come in today with AT&T who wants to get out of his contract without paying the $200. He gets absolutely NO service at his house, is that enough to go on? Understand that I gave him the same sermon as the last one, "You signed a contract, they're allowed to penalize you, blah blah blah" but he is still adamant on trying.
Is lack of service enough to save him?

Generally most companies will let you out of contract and the early disconnect penalty IF there is truley no service where they live. I have seen Alltel let customers out for this same reason... Its up to the carrier though and you are right it does say in the contract that the company reserves the right to do as they please. Best of luck and hope that helps a little!

if the only place he does not have service is his home, then too bad. I'm with AT&T and if he listened/read the terms and conditions of his contract, is states that neither AT&T nor any wireless carrier gaurantees service inside any building.
so if he has service everywere but his home, he still has to pay the Early Termination Fee of $175. Yes, it sucks, but he's gotta deal with it.

not true it all depends on the carrier and how much patience you have. Keep calling and complaining on coverage. If it doesn't work in his house it won't work other places I am sure. Document it and call with every place. . And when do people learn that a contract it seems these days are meaningless. The courts are handing down heave fines tens of millions to ever carrier for ETF fees. Even if the contract clearly states you get one.

site your source. the only lawsuits I've heard of are regaurding prorated ETFs and the wireless carrier has been winning.
btw, these have been HUGE class action lawsuits, so the payout the each individual customer is next to nothing when they all have to pay the lawyer.

It's not INSIDE his house, it's in the area that he lives. As in, if he were standing in his front yard he drops calls constantly because he does not get service.

But if he does not get service on his property but a block away he gets service, he still has to pay the ETF. If he doesn't get service period, then yea, we'll take out the ETF.

umm one carrier settled another lost theirs in California. Which will lead to more in other states. And yes the individual gets little but overall will hurt the company. Sprint already said it will have catastrophic damage to the company if it loses. Do research sorry my access is limited in Iraq.
